These Terms and Conditions (“Terms”) govern your use of SketchAndEtc.com and purchases made through our website.
By accessing our website or purchasing a product, you agree to these Terms. If you do not agree with these Terms, please do not use the website or make a purchase.
1. About SketchAndEtc
SketchAndEtc is an independent creative shop offering products that may include original artwork, prints, digital downloads, creative resources, Procreate brushes, and other art-related products.
Products and services offered may change from time to time.
2. Products and Product Information
We make reasonable efforts to display product descriptions, photographs, colors, dimensions, and other information accurately.
However, colors may appear differently depending on your device or screen settings. Handmade and original artwork may also contain natural variations that are part of the work.
We reserve the right to modify or discontinue products and to correct errors in product descriptions, availability, or pricing where permitted by applicable law.
3. Prices and Payment
Prices displayed on the website are shown in the currency indicated at checkout.
Any applicable shipping charges, taxes, or other charges will be shown where appropriate before you complete your purchase.
Payments may be processed by third-party payment providers. Your use of those payment services may also be subject to the provider's terms and privacy policies.
An order may be declined or cancelled where reasonably necessary, including in cases of suspected fraud, payment failure, incorrect pricing, or product unavailability. If payment has already been collected for an order we cancel, an appropriate refund will be provided.
4. Original Artwork and Physical Products
Original artworks are unique pieces unless otherwise stated.
Because colors and details can vary between screens and physical artwork, minor differences between photographs displayed online and the physical piece are not necessarily considered defects.
Customers are responsible for providing accurate shipping and contact information when placing an order.
Shipping times are estimates and may be affected by carriers, customs, weather, holidays, or other circumstances outside our reasonable control.

5. Digital Products
Some products sold by SketchAndEtc are digital products and do not include a physical item unless specifically stated.
Digital products may include downloadable artwork, templates, brushes, creative resources, or other files.
You are responsible for checking the product description and compatibility requirements before purchasing.
Because digital products can normally be accessed or downloaded after purchase, refunds may be limited once access or downloading has begun, except where required by applicable consumer law or where the product is defective or materially different from its description.

6. Digital Product License
Unless a product listing expressly states otherwise, purchasing a digital product gives you a limited, non-exclusive, non-transferable license for personal use.
The purchase does not transfer copyright or ownership of the artwork, files, brushes, designs, or other intellectual property to you.
Unless expressly permitted by the specific product license, you may not:
Resell or redistribute the original digital files.
Share purchased files with other people or accounts.
Upload the files to file-sharing websites or marketplaces.
Claim the files, artwork, brushes, or designs as your own creation.
Copy or package the files for resale.
Give the files away as free downloads.
Use the files to create competing digital products.
Sell, sublicense, or transfer your license to another person.
Any commercial-use rights must be specifically stated in the relevant product description or license.
7. Procreate Brushes and Creative Resources
Where SketchAndEtc sells Procreate brushes or similar creative tools, the brush files themselves remain the intellectual property of SketchAndEtc or the applicable rights holder.
Unless the individual product license states otherwise, you may use purchased brushes to create your own original artwork.
However, you may not redistribute, resell, share, copy, repackage, or upload the actual brush files for others to download.
Specific brush packs may include additional license terms shown on their product page or included with the download.
8. Intellectual Property
Unless otherwise stated, the website and its original content—including artwork, illustrations, photographs, designs, graphics, branding, digital files, brush designs, written content, and other creative materials—are owned by or licensed to SketchAndEtc and are protected by applicable intellectual-property laws.
Purchasing a physical or digital product does not automatically transfer copyright or reproduction rights.
You may not reproduce, republish, distribute, sell, or commercially exploit our protected content without permission or an applicable license.
9. User Content and Reviews
If you submit a review, photograph, testimonial, or other content to SketchAndEtc, you confirm that you have the right to submit that content.
You must not submit unlawful, defamatory, infringing, fraudulent, abusive, or malicious content.
Where you voluntarily provide content for publication, you grant SketchAndEtc permission to display and use that content for purposes reasonably connected with operating and promoting the shop, subject to applicable law and any agreement made with you.

Nothing in these Terms excludes or limits liability or consumer rights that cannot legally be excluded under applicable law.
